These Terms of Service ("Terms") govern your access to and use of the MobileStreamer live-streaming service (the "Service") provided by Serhan VARHAN — Taksim Bilişim ("we", "us"). By using the Service you agree to these Terms; if you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. By using it you confirm that you meet this age requirement and that you have the legal capacity to accept these Terms in your jurisdiction.
The mobile application registers a device-bound identifier on first launch. You are responsible for safeguarding access to that device. Sharing a paired-viewer link grants the recipient the permissions you selected in the share dialog (playback URLs, metrics, restream, intercom, producer settings); you are responsible for the choices you make there.
You agree not to use the Service to:
We may suspend or terminate access if we have a reasonable belief that you are violating these rules or applicable law.
You retain all rights to the audio/video you broadcast through the Service. By broadcasting, you grant us a non-exclusive, worldwide, royalty-free licence — strictly limited to what is necessary to receive, route, transcode, package, and deliver your content to viewers you authorise. We do not claim ownership and we do not retain copies of your stream contents beyond technical reorder buffers.
You represent and warrant that you have the right to broadcast all content you publish, including any music, performances, or third-party material, and that doing so does not infringe any third-party rights.
Paid plans are sold via Apple App Store, Google Play, or our web checkout. App-store subscriptions auto-renew unless you cancel them at least 24 hours before the end of the current period through your store account. Refunds for store purchases are governed by Apple's or Google's policies. For web purchases via iyzico, refunds may be requested by emailing info@taksimbilisim.com within 14 days of purchase if the Service has not been substantively used.
We provide the Service "as is" and do not guarantee uninterrupted operation. Maintenance, third-party outages, or network conditions may cause downtime or quality degradation. We aim for high availability but make no specific uptime warranty for the free tier.
To the maximum extent permitted by applicable law, Serhan VARHAN — Taksim Bilişim shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or business opportunities, arising out of or relating to your use of the Service. Our total liability for any direct damages is limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or one hundred Turkish lira, whichever is greater.
You agree to indemnify and hold Serhan VARHAN — Taksim Bilişim harmless from any claim or demand brought by a third party arising from your content, your use of the Service, or your breach of these Terms.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or applicable law. Upon termination, sections 4 (last sentence), 5, 7, 8, and 11 survive.
We may update these Terms. The "Effective" date at the top reflects the most recent revision. Material changes will be announced on https://mobilestreamer.app; continued use after such announcement constitutes acceptance.
These Terms are governed by the laws of the Republic of Türkiye. Any dispute arising from or relating to these Terms or the Service shall be exclusively resolved by the Istanbul Courts and Enforcement Offices.
